Driver On Probation Busted For Fourth DWI During Stop In Westchester

A Westchester County man on probation with three previous DWI convictions is facing a host of charges after being busted allegedly drinking and driving without a license in Scarsdale.

An officer on patrol at approximately 11:30 p.m. on Weaver Street on Monday, Feb. 4 was alerted by a License Plate Reader that a 2013 Chevy Traverse that drove by had a “suspended or revoked” registration. It was determined that the car’s registration had been suspended due to an insurance lapse in October last year.

During the subsequent traffic stop, the officer spoke to the driver, New Rochelle resident David Alvarez, who stated he did not have a license. When asked what his name was, he said “David Gdoy.” When asked if he had any ID to confirm his name, Alvarez initially said no, but then produced a wallet and began looking through it, at which point the officer spotted a New York State ID card.

Police said that the ID stated the driver’s name was David Alvarez, and a computer check found that his privilege to drive had been revoked due to two prior DWI convictions in the past 10 years. He was also forbidden from driving without an interlock device, which was not in the Chevy.

The officer said that while speaking with Alvarez, there was a strong odor of alcohol on his breath and his eyes were glassy and bloodshot. Alvarez was ordered out of the vehicle and proceeded to fail multiple Standardized Field Sobriety Tests. When prompted to take a breathalyzer, Alvarez had a blood alcohol content of .12 percent and he was arrested.

Alvarez, 39, was arrested and it was determined he had a blood alcohol content of .10 at Scarsdale Police Headquarters. Alvarez was charged with driving while intoxicated with two previous convictions, operating a motor vehicle with a blood alcohol content greater than .08 percent for the third time and aggravated unlicensed operation of a motor vehicle, all felonies. He was also charged with misdemeanor counts of using a vehicle without an interlock device and operating a motor vehicle with a suspended registration. Alvarez was also cited for operating a motor vehicle without insurance.

Police noted that Alvarez is currently on probation with Westchester County. Following his arraignment in Scarsdale Village Court, Alvarez was remanded to the Westchester County Jail in lieu of $5,000 cash bail or $10,000 bond. No return court date has been announced for Alvarez.
